Illegal immigrants rallying today. Hopefully this will be a positive push for CIR (as opposed to the perceived negative it was last year).

1. DREAM Act
2. AgJobs
3. Make the EB-1 category more reasonable.
4. Create a more reasonable bar on those accused of providing material support to terrorists to cover those essentially involuntarily providing the support.
5. Eliminate the one year bar on asylum claims.
How about clearing the backlogs in the employment based system? We are contributing to the wealth of the company and the economy but our futures are in limbo and the best years of our careers are wasted worrying about a green card!
Not surprisingly, according to the most recent State Department Visa bulletin, the EB-1 category is one of the only employment-based category without a waiting list.
Does that not indicate a problem that needs to be fixed instead of ignored as you have done Philip Wolgin?

Yes, Travel via London needs:
EITHER Valid Visa stamping in Passport to Destination Country
OR Direct-Air-Transit UK Visa stamping in Passport
Advance Parole is really a valid Entry Permit - but, it has a class about the officer may still deny your admission. This class is a statement to send the candidate back if they do not want to allow due to some issues after the AP is issued, etc. So, some countries (like UK) do not allow to fly in AP without valid visa stamping.
FYI: My friend travelled via Germany and he returned back OK. Going to India via Germany is not an issue for Indian Citizens - but, Germany had the same rule as UK 2 Yrs back for returning to USA sector. Looks like, Germany allows transit travel using APs now-a-days. Not sure 100% about return to USA using AP , better to check.

A key figure (http://news.google.com/news?hl=en&ned=us&q=hastert&btnG=Search+News) in the latest political drama was a key figure in immigration debate (http://news.google.com/archivesearch?q=hastert+immigration&ie=UTF-8&oe=UTF-8&btnG=Search+Archives). I wish he makes way and hopefully some moderate does something for the immigrant community.
Just curious. Do you know of any reason why he might make way for someone else?

I'm trying to do H1 transfer but my case has some complications and henc am worried if I should go forward or stick with my current company though they are sucking my blood outright.
1. My company does not give me paystubs(which I know is illegal, but they are ruthless that they might withdraw their application if I fight them). Is it possible to do H1 transfer with one paystub if I somehow manage to get one from them(By lyin as in for bank loan)?
2. I had done only undergrad (3 yrs) when they applied for my H1. I had my MBA going but havent graduated when H1 applied and they actually applied by putting my part time experince as full time experience and got my H1. They totaly masked my masters. Is it advisable to continue with my 3 yrs degree and partly fake experience or put my masters in the transfer appln. Would I get any query on that? But one good explanation is I finished my MBs around the same time as I applied H1 and so I can explain it to USCIS but still I'm worried. Any body in smilar boat?

yes, that is correct, i meant can i got for H-1 stamping while 485 is pending
and ead/ap is approved.
Again in case the H-1 stamping is denied for any reason , can i come back on AP
I am a little concerned of H1 stamping being a problem because my case is complicated ,for the years June 2005- June 2006 i dont have a H1 approval from USCIS for the 6th year, This was because the case was stuck in a security check .
We applied a case again in April 2006 , which was approved on August 2006 ( after the security check has been completed ).

All,
I am a little confused. I just got my H1B extension done recently and my attorney sent me a letter saying that if I go out of the country for stamping I need to make sure my Passport is valid beyond the H1B period.
My passport expires in May 2008 and my current H1 is valid till July 2010. Does anyone see any issues in going for stamping in India in July 2007 with my current passport and later on some time next year applying for a new Indian passport.
Appreciate your help

The expenses for a normal delivery would be between 10-15000$ if everything goes fine.Medicare help is from federal so it would be better if its not taken risking the GC.Usually the hospitals gives some break depending upon family income, so even if its 50% its not bad.Else going to home country but at this stage doesnt look wise.

Hi Folks:
Is there a time limit for one to travel on Advance Parole. I was told that if a person travels abroad and intends to enter using AP, the maximum time allowed is 6 weeks, is this true?
Thanks

Why is receipt date different on the I485/EAD.
I am reading some of the posts from other members.
Their receipt data on the EAD is different(at least 1, 2 months delayed) from the date USCIS actually received their application. I thought USCIS is going to honour the actual date when they received the application by mail.
It is obviously more than 2 months late for many of the applications.
If some one to use AC21 portability, what exact date is honoured? the date when USCIS received the application or the receive date printed on the EAD?
Is the date when USCIS received is stored some where?
In my case, I filed my I485 on July27 at TEXAS Service Center, I received a notice on Oct 6 from CALIFORNIA Service Center, Details below :
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Receipt Date : Oct 1, 2007
Notice Date : Oct 2, 2007
Current Status: This case has been sent to another office for processing because it has jurisdiction over the case.
On October 2, 2007, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. We sent you a notice of this transfer. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you.....
Now, I am not sure, what exactly is my Received Date. And how it went to California Center? I have confirmation from FEDEX tracking that it is delivered to Texas Center.

Hi, Just make sure with your HR if the new company will grand fathered all the aggreement (esp your GC process). Same thing happened to me a year ago and I don't need to file anything.
so for summary :
a. Do I have to go through the entire GC process again with new company?
>> no
b. Do I have to refile 140 ( labor?) I know H1-b will have to be refiled and they are aware of it.
c. is there anything that must be added to the 'closure' document as part of the deal, that will
help GC transfer smooth( deal is not closed yet, so such clauses can be included still)
>>>the safest thing might be to file AC21. but again, it will depend on ur HR/Lawyer
d. Should I stay with my current employer?
>> up to you .. only you can feel the situation post acquisition.
btw in my case, my old company name is totally gone and my business unit brought the old company name into a new division of the new company . in your case looks like the old company name is still there.
Thx

Hello,
According to my knowledge the majority of name checks submitted are electronically checked and returned to the submitting agency as having "No Record" within 48-72 hours. The processing time for FBI name checks usually take from 30-120 days but timing does vary from case to case. The FBIs intention is to have all visa requests processed within 120 days. Most name check requests that are over 60 days old are the result of the time required to retrieve and review field office record information. Any case which is not processed within this time frame is usually delayed because of a potential "hit" which will be further reviewed manually.

I don't intend to get a second H-1.. The second job that I want to do is just 3-5hrs a week and dont want any sponsorship for it.
U dont have an option. If you want 2 paid jobs, you need to have 2 H1s. I dont know of any exceptions to this rule.
